Tila Tequila may have been out-crazied by an L.A. photographer who claims Tila, along with 4 armed men with guns, kidnapped his alleged girlfriend and threatened to kill him … this according to court documents obtained by TMZ.

Photographer Garry Sun filed an application for a restraining order in L.A. County Superior Court, claiming on October 19, Tila and the armed men drove to the Texas house of his alleged girlfriend, Shyla Jennings, kidnapped her, somehow got Shyla on a plane and flew her to L.A.

Sun claims Tila then threatened Shyla … If anyone notified cops, she and Garry would be toast.

A judge has not ruled on the restraining order. 

Tila says Sun made the whole thing up and she’s calling her lawyer. 

UPDATE: Tila’s lawyer calls the allegations, “patently absurd” … and insists Sun is simply filing the lawsuit to “get back at [Tila]” after he was fired from his role on Tila’s website.

The lawyer adds, “[Sun] will undoubtedly be held accountable by appropriate authorities for making these false allegations.”

What do you do when one of your three-way sex tape partners blocks the sale of the flick? If you’re “Bad Girls Club” hell-raiser Erica Langston … you simply sell your OTHER sex tape. Duh.

Sources tell TMZ Langston and one member of the ménage à trois — her boyfriend Adrian — tried to sell their masterpiece to Vivid Entertainment head honcho Steve Hirsch earlier this week … but sex tape partner numero tres threw a wrench in the deal.

We’re told #3 — who happens to be one of Langston’s “BGC” castmates — demanded way too much scratch for the tape … around $200k … so the deal went sour.

But our sources say Langston had an ace in the hole — another sex tape with Adrian … sans her financially demanding XXX cohort. 

We’re told Hirsch made a new offer for the two-person porno … and that the deal is all but sealed.

Danielle Staub just got tricked and then treated — to a lawsuit from a process server who gave the former “Real Housewives of New Jersey” star a serious shock at a Halloween party.

A TMZ photog saw the whole thing go down just minutes ago — as Danielle was served for a defamation lawsuit her ex-boyfriend Steve Zalewski is bringing against her.

Danielle was just starting down the red carpet at a Halloween event in Woodridge, NJ when the process server walked up with an envelope and said, “Here, Danielle … you’ve been served.”

Danielle was stunned, but didn’t miss a beat — she simply handed the envelope to her publicist and continued down the red carpet into the party.

According to sources, Zalewski is suing Danielle for defamation
because she has repeatedly accused him of secretly shooting a
sex tape of her — which he denies doing.

Facebook is buzzing with news of a Lindsay Lohan three-way sex tape — news that we’ve learned is patently untrue … at least that’s what Lindsay is telling her closest friends.

We’re told Lindsay just became aware of a Facebook page teasing, “Lindsey [sic] Lohan Just Leaked Having a THREEWAY on Camera.”

A message on the page continues, “Don’t ask how i got this … NO ONE ELSE HAS SEEN THIS VIDEO.”

But sources close to Lindsay tell us the actress is adamant that no 3-way sex tape exists. Sorry guys .. and some ladies.

Oksana Grigorieva‘s lawyer accused Mel Gibson during his deposition Monday of clenching his fist … but the judge ruled there was absolutely no proof it happened.

Here’s what we know … The deposition got so contentious and loud among the lawyers … people in the office building heard the noise.  Sources say at one point, Oksana’s lawyer, Daniel Horowitz, accused Mel of winking at him — a comment the judge promptly struck from the record.

Horowitz then said on the record … he believed Mel clenched his left fist.  Again, the judge struck the comment from the record.

What’s interesting … the proof is in the video, which was rolling during the whole depo.  But as far as we know, there’s no evidence Mel clenched it.

Charlie Sheen is acknowledging he has a substance abuse problem, and he’s hired a sober coach to hang with him … TMZ has learned.

Well-placed sources connected with “Two and a Half Men” tell us … the sober coach is living at Charlie’s house and accompanying him to work. 

Charlie has spent time with sober coaches in the past, with mixed success.

How’s this for irony … getting sued over a court appearance … which is exactly what’s happening to Jesse James‘ ex-wife, Janine Lindemulder.

We’ve learned the photog who went down hard during Janine’s court appearance in October is filing suit against her, claiming she committed a battery against him and he suffered injury as a result.

Kat Von D put up one hell of a fight — but TMZ has learned producers behind “L.A. Ink” have decided to include footage of Jesse James in the season finale, despite Kat’s demand to cut him from the show.

Sources connected to the TLC reality show tell us … “Ink” execs felt they would be “sacrificing the integrity of the show” by ignoring Kat’s headline-making relationship and break-up from James in tonight’s season finale.

As we previously reported, Kat flipped out a few weeks ago when she saw a preview of the finale — which featured the relationship — and demanded producers either pull the footage, or she would refuse to participate in future production.

Kat lost that battle — but she did score ONE victory … we’re told producers did agree to cut some controversial footage showing Kat bad-mouthing another one of her exes, Nikki Sixx.
